SHRIMP and abalone Compliance Provisions for the Seafood Import Monitoring Program EXTENDED through April 1, 2019
NOAA Fisheries, in collaboration with U.S. Customs and Border Protection, has extended the period of “informed compliance” for submission of SIMP data for shrimp and abalone, from December 31, 2018 through April 1, 2019.
On December 31, 2018, it became mandatory for foreign shrimp products to be accompanied by harvest and landing data and for importers to maintain chain of custody records for shrimp and abalone imports entering the U.S. The Seafood Import Monitoring Program—also known as SIMP—established reporting and recordkeeping requirements for imports of certain seafood products to prevent illegal, unreported and unregulated and/or misrepresented seafood from entering U.S. commerce.
The inclusion of shrimp – the largest US seafood import- and abalone in SIMP nearly doubles the volume and value of imported fish and fish products subject to its requirements, further leveling the playing field for U.S. fishermen, aquaculture producers, and seafood producers around the world who play by the rules. Mandatory compliance for the other species covered under SIMP began on January 1, 2018.
What does this mean?
Entries will be audited, inspected, and verified for the “informed compliance” starting December 31, 2018 through April 1, 2019. However, entries specifically of shrimp and abalone tariff codes will not be rejected if their SIMP data is omitted. This period of “informed compliance” is established to assure that trade has the opportunity to work through any inadvertent, unintentional, or technical or concerns that may have precluded their being fully prepared to successfully submit SIMP data for shrimp and/or abalone with the Entry. By April 1, 2019 entries that do not comply with the mandatory SIMP message set requirements, including shrimp and abalone, will be refused entry.
